Investment Restrictions Control Reporting

Investment in a fund involves potential risks. In order to mitigate these risks, the fund may be subject to investment regulations and restrictions. Investment restrictions would typically restrain or disallow investments into a specific instrument type, specific geographical and economic sector as well as specific types of issuers. Restrictions would also encourage diversification of investments to some of the above-mentioned characteristics or provide thresholds, bands or limits for general characteristics of the portfolio i.e. duration, exposure, etc.

The investment restriction control function is achieved by fully dedicated staff under the responsibility of the Funds Accounting Manager. The purpose of the function is to ensure that the investments are made in accordance with:

  • The regulatory framework of the entity’s country of domicile.
  • The investment objectives, policies, guidelines, restrictions and management regulations as laid out in the legal documentation of the entity.

Statutory and Regulatory Reporting

A dedicated team is in charge of all statutory and regulatory reporting of Luxembourg Domiciled Funds, Cayman Domiciled Unit Trust and Mutual Funds and other offshore Special Purpose Vehicles.

Scope of services provided by NBL encompasses:

  • Regulatory reporting to the Japanese supervisory authorities for structures publicly distributed in Japan on a semi-annual basis in cooperation with Japanese lawyers.
  • Regulatory reporting to the Luxembourg supervisory authorities for Luxembourg domiciled funds on a monthly, quarterly and annual basis.
  • Financial reporting on an annual or semi-annual basis under LuxGAAP or IFRS. Consolidated or combined reports are also issued when required.
  • Assistance to external fund auditors in order to ensure completion of the audit within set deadlines.
